About these terms
Gyvio is operated by Salesive Force Ltd, a company registered in Nigeria, of No 1 Eugene Oba Street, Agbani Road, Enugu 400252, Enugu State, Nigeria ("Gyvio", "we", "us"). These terms are an agreement between you and Salesive Force Ltd.
These documents are part of these terms:
- Community Guidelines: what is and isn't allowed.
- Dash Coins, payments and Gyvio+: how money works on Gyvio.
Our Privacy Policy explains how we handle your personal data, and our Safety page explains how to report and how we moderate.
Who can use Gyvio
- You must be 18 or older. We ask for your date of birth when you sign up and it must be true.
- You must be able to make a binding agreement, and not be barred from using Gyvio by law or by an earlier ban from us.
- Some features only work in some places. Cash-outs, for example, are only paid to Nigerian bank accounts.
Your account
- You sign in with your Google account. Keep that account secure: anyone who can sign in to it can use your Gyvio account.
- The information you give us, such as your name, date of birth, country and gender, must be accurate. Your date of birth can't be changed later, and your gender can be changed once every 30 days.
- Your account is personal to you. Don't share it, sell it, or let anyone else use it.
- You are responsible for what happens on your account. If you think someone else has got into it, tell us straight away at support@salesive.com (subject: "Gyvio support").
- Usernames are first come, first served, but we may take back a username that impersonates someone, infringes someone's rights, or is offensive.
What Gyvio offers
Gyvio lets you post photos and videos, share 24-hour statuses and Flicks, comment and react, chat one-to-one with voice notes and disappearing messages, join and run rooms, make voice and video calls with friends, meet new people by video in Meet, and send, earn and cash out Dash Coins. Some features, like Gyvio+ benefits, depend on your membership or trust level.
Our website also describes features we are building, such as brand campaigns and coupons. They are not part of Gyvio until they appear in the app, and they may come with their own terms.
Your content
You own it
What you post, send or upload on Gyvio ("your content") stays yours.
The permission you give us
So that we can run Gyvio, you give Salesive Force Ltd a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, adapt (for example resize or compress), display, and share your content with the people you choose, for the purpose of operating, improving and keeping Gyvio safe. This licence ends when your content is deleted, except:
- where others have already reshared it or reused its sound, as Gyvio allows,
- for copies we must keep for legal reasons or to deal with abuse, as our Privacy Policy explains.
We won't sell your content or give it to advertisers.
Sounds and stickers
When you post a video, its sound can be used by other people in their own posts on Gyvio, with credit to you. Stickers you upload can be used by anyone on Gyvio. By posting, you allow this. Only post sounds and stickers you have the right to share this way.
Your responsibility
You are responsible for your content. You confirm that you have the rights to it, and that it doesn't break these terms, our Community Guidelines, or anyone else's rights. We don't check content before it is posted, and we are not responsible for content posted by others.
Links
When you put a link in a chat or room, our server visits the page to show a preview. We are not responsible for other websites.
Rules of use
Follow our Community Guidelines. In addition, you must not:
- break the law, or help anyone else to, using Gyvio,
- scrape, crawl or collect data from Gyvio by automated means, or collect other users' data,
- use bots, scripts or fake accounts, or manipulate views, likes, followers, streaks, ranks or rewards,
- get around limits, bans, blocks, trust levels, age checks or Meet bans,
- interfere with, overload, probe or attack Gyvio's systems, or try to access accounts or data that aren't yours,
- copy, modify, reverse engineer or resell Gyvio or any part of it, except where the law allows,
- use Gyvio's name or logo in a way that suggests we endorse you.
Meet and calls
- Meet connects you with people you don't know. We work hard to keep it safe, but we can't control what other people do or say, and we can't guarantee who they are. Use your judgement, and tap Next or report if something isn't right.
- You must accept the Meet rules before using Meet. Breaking them gets you banned from Meet, as described on our Safety page.
- You agree that when a report is made about a Meet chat you are in, one still picture of that moment is sent to our safety team for review, as our Privacy Policy explains.
- We may use automated tools to help detect content that breaks our rules, in Meet and elsewhere. No such tool is perfect, and we don't promise to catch everything.
- Calls and Meet chats connect the two phones directly where possible, which lets each phone see the other's IP address.
- Don't record or screenshot anyone in a call or Meet without their permission.
Dash Coins, payments and Gyvio+
Our Dash Coins, payments and Gyvio+ terms are part of these terms. In short:
- 1 Dash Coin = ₦1. Dash Coins can only be used on Gyvio and are not a deposit, electronic money or an investment.
- Only earned coins can be cashed out, from 2,000 coins, to a Nigerian bank, with a 10% fee.
- Top-ups and Gyvio+ are paid through Paystack and are final: Gyvio does not refund purchased coins or Gyvio+.
- Gyvio+ costs ₦2,000 for 30 days and never renews by itself.
- Limits depend on your trust level.
Moderation and enforcement
We may review content and accounts, including when they are reported, and we may:
- remove or hide content that breaks these terms or the law,
- give strikes that lower your trust level and limits,
- ban you from Meet,
- suspend your account (you can look but not post, pay or chat) or ban it (you can no longer use Gyvio, and every Dash Coin in the account, bought or earned, is forfeited, including cash-outs not yet sent),
- hold, reject or reverse coins and cash-outs connected to fraud or rule breaking,
- report illegal activity to the authorities.
We decide what to do based on how serious a breach is and whether it has happened before. If you think we made a mistake, you can ask us to look again (see Safety). Nothing in these terms stops you from taking any step the law gives you.
Other companies' services
Gyvio relies on other companies, including Google (sign-in), Paystack (payments and payouts) and Cloudflare (hosting and file storage). Their own terms apply when you use them, for example on Paystack's payment page. We are not responsible for their services, but we choose them carefully.
Changes to Gyvio
Gyvio is new and changes often. We may add, change or remove features. If a change takes away something important you rely on, we will try to tell you in advance.
We may update these terms. We will change the date at the top, and for significant changes we will tell you in the app before they take effect. If you keep using Gyvio after that, the new terms apply. If you don't agree, you can stop using Gyvio and delete your account.
Leaving Gyvio, or us ending your access
- You can stop using Gyvio at any time and delete your account yourself, in Settings. See Delete your account. Cash out any earned coins first.
- We may suspend or end your access if you seriously or repeatedly break these terms, if the law requires it, or if your use creates risk or legal exposure for us or others. Where it is reasonable, we will tell you why.
- Parts of these terms that by their nature should continue after your account ends (such as the licence for content already reshared, disclaimers, limits on liability, and governing law) continue.
Disclaimers
We work hard to keep Gyvio running well and safely, but we provide it "as is" and "as available". To the extent the law allows, we don't promise that Gyvio will always be available, free of errors, or secure, or that content on it is accurate. Content on Gyvio comes from its users, not from us, and doesn't reflect our views. Nothing here limits rights you have as a consumer that the law says can't be limited.
Limits on our liability
To the extent the law allows:
- we are not liable for losses caused by other users, by other companies' services, or by events outside our reasonable control,
- we are not liable for indirect or consequential losses, such as lost profits, lost opportunities or lost data,
- our total liability to you for any claim about Gyvio is limited to the greater of the amount you paid us in the 12 months before the claim and ₦50,000.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow us to limit. This includes our obligation to pay out earned coins in line with these terms.
Your responsibility to us
If someone makes a claim against us because of content you posted or because you broke these terms or the law, you agree to cover the reasonable costs and losses that result, to the extent the law allows.
Governing law and disputes
These terms are governed by the laws of the Federal Republic of Nigeria. If you have a problem, please contact us first at support@salesive.com (subject: "Gyvio support"); most issues can be solved quickly that way. If we can't resolve it, the courts of Nigeria have jurisdiction, subject to any right you have under the law of the country where you live to bring a claim there.
General
- These terms, with the documents they include, are the whole agreement between you and us about Gyvio.
- If a court finds part of these terms can't be enforced, the rest still applies.
- If we don't enforce a term straight away, we can still enforce it later.
- You can't transfer your rights under these terms to anyone else. We may transfer ours to another company that takes over Gyvio, and we will tell you if we do.
